FOR IMMEDIATE RELEASE   [Hastings, MN, December 27, 2018] After seven days of trial in the case of Christina Ginther v. the Independent Women’s Football League, et al., the jury returned a verdict in favor of Ms. Ginther and at the same time vindicated the MN Vixen and its manager Laura Brown.   The MN Vixen is an inclusive and inviting nonprofit organization.  So when it came to the MN Vixen’s attention that the Independent Women’s Football League (IWFL) prohibited transgender athletes from participating—the league’s rules require players to certify that they are now and “have always been legally and medically female”—the MN Vixen proposed an amendment to the rules that would allow transgender athletes to participate.  When Ms. Ginther tried out for the MN Vixen in October of 2016, the IWFL’s rules still banned transgender athletes and, and as an ineligible player, the MN Vixen could not offer Ms. Ginther a roster spot. Disgusted by the IWFL’s policies and refusal to change to be more inviting, within weeks and well before Ms. Ginther filed her lawsuit, MN Vixen left the IWFL for the Women’s Football Alliance, which allows transgender athletes to participate.  The MN Vixen have proudly had transgender athletes on their team ever since.   Ms. Ginther sued the MN Vixen, its manager, Laura Brown, and the IWFL for business discrimination under the Minnesota Human Rights Act.  On December 18, 2018, trial culminated when the jury concluded that Ms. Brown did not discriminate against Ms. Ginther, found that the IWFL’s policy was discriminatory, and found that the MN Vixen were acting as the agent of the League in applying the rule.  The jury awarded Ms. Ginther $10,000 for her mental anguish and because the MN Vixen were the IWFL’s agent, the IWFL, not the MN Vixen, are liable for Ms. Ginther’s damages.  The jury also awarded Ms. Ginther $10,000 in punitive damages against the IWFL but did not award her any punitive damages against the MN Vixen. The MN Vixen is now attempting to recover its attorneys’ fees and costs from the IWFL.
